Not quite sure how this affects folk wanting to take their Thai spouses to the UK but interesting reading...........the BBC today.

They're not saying that any EU citizen married to any non-EU citizen can have them live in their country, as if there are no entry requirements other than being married.
They're saying that these non-EU citizens (African men) married to non Irish EU citizens who live in Ireland can also live in Ireland with them. Previously the Irish govt had said they could only do so if they'd previously lived in another EU state.
That's my understanding anyway.

two weeks in another EU country either working or as a job-seeker is apparantly enough... similar cases ongoing in Denmark at the mo and heads will probably roll...

Now, I haven't read the full ruling yet, but I will certainly be doing so shortly (once I can find it). However, it is most unwise of any EU member country to ignore EU directives (don't you just love that word? Ultimately fascist diktats which can supersede national government decision-making). The European Court has always enjoyed shoving the law up member country's rear ends (the UK tends to wear these directives without question, the French usually ignore the ones they don't like).

For the time being I tend to agree with Jon, in that it doesn't necessarily open the floodgates, but it is certainly a ruling in the right direction. It is surely only a matter of time before we are freely able to take our wives and families to our home country without being subjected to the whim of petty, moody, immigration officials.

I'm pretty confident that EU laws already protect a EU citizen's right to "happiness"... if you're not happy living without your spouse or kids then the case becomes pretty clear (and I'm almost certain that there are a fair few crafty immigration lawyers working on this as we speak... there's big money in it).

I'm not a big fan of the EU, per se, but then again, I'm not a terribly huge fan of the unrelenting illegal immigration into my home country which, seemingly, goes unpunished... in fact, the illegals are almost always handed a place of abode and reasonably generous benefits upon arrival (plus free dental care, health care, education for their kids) without ever having contributed a thing. Much more than the average local ever receives from their government in times of need. Once these illegals are in, it's an absolute bugger to get them out again, in spite of their having broken numerous laws in the first place.

It's about time that justice worked in favour of the EU citizen, rather than the law-breakers.
