Told my school I was planning on returning to England, so can't stay around to work the new term. I signed a 12 month contract and it is due to run out at the end of April. I have now been told that I wont get paid my final pay-cheque because I am leaving. Can they really do this or are they just trying it on? As far as i can see I have not broken any part of my contract; merely declined to sign a new one. I thought working for a government school that they wouldn't try anything as shady; but I was wrong.
They already have a replacement signed-up and he wont start getting paid until the 1st of May. All the other teachers will get paid for April as normal.
Work in Korea or somewhere and you get a big fat bonus and a flight home at the end of your contract; in Thailand you merely get a kick in the balls!

A year ago I left a school. In the contract we agreed that the school would pay the tax. When I did my tax clearance at the end of March 2007, I had to pay an extra 10,000 THB. The school had paid too less tax. The school didn't want to pay for it related to the fact that I would start at a new school in May 2007.
I told them that my lawyer would contact them. They paid.
I hope that this will work for you too. If it really comes to hiring a lawyer and bring up a case, it can take quite some time. You will win though.

This is what I did when I crashed my car and had problems with Honda fixing it. After I told them that I would come with a layer they fix the car in no time.
Take no prisoners wildbill, threaten them, they are leaning on the rumour that farang have no rights in Thailand, and if you believe it, then that is what you will get. Stand up for yourself. I would like to hear re_fuse response, I am sure he would have an appropriate reaction but I completely agree with Stamp.

never mind the good old chap has been working here for.. years and could possibly go back to England and recommend us with his mates, maybe he could set us up with some teachers in the future, and besides if I break my contract he might put me on a blacklist, and it will be very hard to continue to do business, ho wait that's western thinking.....

but ofcourse that bit of info is completely useless to you now, anyho good luck, threaten them a bit, if that don't work, say your going to take home some school equipment, hold back the grades or whatever.

My first reaction would be to shoot the school up ..but that is fraught with problems
Just get a lawyer to write a letter ..They will be scrabbling to settle out of court.
I think it is time for all of us to put our heads together in a very nicely worded letter to the King. Most likely not be responded to and quite possibly put in the rubbish bin ...But I cannot hurt to try.

How about a friendly call to the local labor or education office? If your Thai isn't sufficient, take someone who can translate for you.
If you don't get any satisfaction THEN get a lawyer.
Cheers for the support guys. My initial reaction was to say 'mai pen rai' but now when you think about it they really don't have a leg to stand on. There is nothing in the contract relating to this at all.
I think the first step is to go down to Ministry of Labour with the missus and to ask a few questions, then maybe speak to her sisters lawyer. Threaten to get medievil on the ass and I'm sure they will cough up.
They have no choice.
