I'm currently working in Phuket, and my school is going through the application process for a work permit for me. Today they told me that the immigration office told them they couldn't issue me with one because I already hold a Songkhla work permit. This old permit was from a job that I finished just under a year ago, but I wasn't aware at the time that I needed to do anything to cancel my old one. I never heard anything about it from the school or the agency I was working with at the time.
To make matters worse, I'm currently frantically searching for the work permit, but I've moved a few times and I can't find it at the moment. It might turn up, but let's assume for now that I have lost it.
What are my options in this situation? My current Non-B visa expires on the 26th of September, so I would VERY much like to avoid another trip to Penang and to have my new work permit by then so I can extend my current visa.
Am I going to have any trouble cancelling the old work permit? How do I go about doing that? Seeing as I've lost it, AND the fact that I haven't even been working at the school it's tied to for nigh on a year, I'm panicking a bit.
I don't get this. Immigration issues extensions of the temporary permission of stay. They don't issue work permits.
When you stopped employment before the expiration of your employment contract you had to surrender your work permit and had to cancel your extension of stay provided you had one.
Can you tell us what you did in the period let's say November 2011 and 28 June 2012.
I'm still missing something. Your old work permit is gone and so did the extension of stay. It's even in another province with a different Immigration Office and Labour Office.
I got my offices mixed up. I meant the labour office, not the immigration office.
I was working for an agency at the time I received the Work Permit - I stopped working for them last October, and worked at another school in the same city until March this year when I moved to Phuket and started my current job in June.
When I finished working for them, I asked them about the work permit, the agency told me that I didn't need to worry, and that I could just stay on my extended visa. I now see that they were very wrong, and that they should have cancelled my work permit and I should have left and re-rentered the country.
That extended visa expired in March this year - the job I worked between October and March seemed happy with me simply saying I didn't need a visa, and never even offered to get me a Non-Immigrant B. I've since gotten another non-imm-B visa with paperwork from my current job.
It's a bit of a mess really, partly because that first agency was wrong, and partly because of my own naievity and lack of knowledge about the system here, and just assuming I was OK on that original extended visa.
Contact your former employer and ask them to cancel your old work permit/ sign you out as being a work permit holder in Songkhla.
