as a matter of fact, this individual has already been granted bail. his family flew to Thailand and by some miracle they got him out on bail. however, he is still in big trouble, and could still face prison in the end. the court is holding his passport now, and they will not return it until the case is finished. the lawyer seems to think he can get probation, with a fine, and deportation... of course, the smaller the results from the lab, on the final charge sheet, the more likely this outcome is. which is why we are focusing on this now.
we do not think fleeing is an option. there is a bilateral treaty with thailand and USA for extradition, although I might hazard a guess that for a case this small that might not happen in the end... however, it could seriously damage this individual's future at home, if he can't get a passport again, or if he faces criminal charges... who knows? we have no idea how a situation like that might play out, which is precisely why we are hoping for a good, legal, resolution through the Thai system. we are all hoping the court will be lenient, but from what we know the thai courts are very unpredictable, and they can give extremely harsh sentences for (relatively) small infractions.
