Well, on Thaivisa, an employer asked a similar question and was told he would have to pay out the whole salary to the member of staff who just quit. And regarding that 100 k countersuit, that's just TALK. You haven't been sued - and I doubt you will get sued.

The following is none of my business. Forgive me for asking some questions:

What made you jump ship like this?

Was there some dramatic incident? Or has this been your plan - for weeks or longer?

Your offer of "help" won't be appreciated. Instead, it will likely vex them some more!

You got a new contract at some other school - or are out out of jobs? I'm confused based on what you say about the work permits... You better leave the country pdq as yours will likely get cancelled and then you have only a day to leave.

Was it really necessary to quit? You only had 2 or 3 more months left.
    .............
I'm constantly moaning and complaining. But the school pays my salary and I gather they need me.

Go get your salaries - it's the law. Labour Court is free. They provide attorneys and that meeting is an indication that no one wants to sue anyone. Or else they would be done talking.

One last question, would you do it again - if you could go back in time?

    Chris

Wrong. According to Siam Legal in their answer to an employer who was told he could not withhold salary for time that was worked.

in your position i'd a) find a lawyer, and b) make sure that lawyer comes with you to that meeting.
Really? TEFLers on foreign passports - and with court cases taking years? So you think they will really sue the guy and his wife? Nah. Wasting time and money without any chance of success, that would only make it worse for the school. And AFAIK the o.p. has yet to divulge what made them quit with such a short notice after 3 long years...

Do you have new jobs lined up?

The O.P. Should tread very carefully, some years back I had an acquaintance who went down the same road, the consequences were indeed dire.

He went to another school and after some three or four weeks the police called at his new school and arrested him.Off to the police station and into the cells.

He managed to contact me among others and we found him a lawyer. The upshot wsas that the breach of contract cost him or rather his family in England some 300,000 baht .

School compensation was if my memory is correct about 125,000 baht, lawyers fee's and the price of a one way ticket to the U.K.. Plus other odds and sods took care of the rest of the money.

A breach of contract is a serious legal matter, the Thai Labour Courts are indeed fair to all parties, suggesting a settlement action out of court as a first step, if that fails well the law takes its course,

Don't be blaize about the matter, it could well turn nasty, evert action has a consequence.

The O.P. Is in breach of his or her contract , a hard copy letter sent by E.M.S. Giving one clear month of notice would have been the professional way to deal with the matter.Or to be totally honest having the decency to actually honour the contract in the first place.

We sometimes wonder why teachers get shafted, the O.P is one of the prime reasons for the treatment of foreign teaching staff here in Thailand.

it's all in how you do it. if you go to 'em with puppy dog eyes, in tears over how you'll miss your satudents, and explain that your dream job in Pakistan has suddenly come up, and that your background is in dance, and dammit you always wanted to teach Pakistani autoriksha drivers how to bust out the latest hip hop moves, they just might come around. but email cons are lame. they're so... 419.

    get on down to labor...
    They cannot withhold payment...
They can try to sue you through civil law, but not labor.

Tell labor that you and your wife are leaving for emergency reasons and need to be paid your rightful salary for the month's work. Do no get up set at the labor office. Smile and be pleasant.

Indeed. Better to wait one more minute and at least get a giggle out of the situation.

very interesting point. if successful, the OP can then apply the money to settling out of court.
