Hello!!
My wife and I work in a private school for almost 3 years this year.. It's supposedly finish in October. But, we sent our resignation letter through email last July 27, 2012 and said that we will work until the end of July (July 31, 2012).
We didn't find any response from them. No email response, phone calls or administrative calls. But, we tried to call the one of the administrators but no answer.
So we thought and assumed that everything is fine. until then at 10:00 am of July 31,. The thai-school lawyer called me and informed me that we sent the email in less than 30 days. He also informed me that they gonna terminate our workpermit and sue us 100k baht for school damages..
We were afraid in hearing those information. and to make it worst , they didn't pay us our monthly salary.
so here are my questions.
1. in there contract, it says that "cancellation of conract can be made only in mutual agreement pf both parties. A written notification for amendment must by either party not less than 30 days in advance"....only that.. no other clause/s followed. Why do they sue us for 100k as for school damages? Is it really school damages?
2. the time we signed the contract.. it was duplicated into 3 copies.. but they didn't give us one copy.. Strange, but i borrowed ones and made a multiple copies. As well as the Workpermit.. I borrowed but didn't return to the school. So, Is it possible to terminate the contract by myself?
3. Since they didn't give our monthly salary. Can we file a case for it?
4. They are asking for a meeting this August 6.. Monday.. Do we still need to go there? Do we need to negotiate about our work permits and ask for a transfer of Work permit in another school if ever got a new one.
Need your opinion guys ASAP..

Yes.. I sent to the assistant director who is also the son of the owner. But the school attorney was the one who called me up and informed me that i sent the letter in less than 30 days.
...so...you gave the school 4 days notice to find 2 teachers and you assumed everything was fine?...and you're complaining about the loss of a month's salary?...you are obviously the victims of a disapponted and vengeful school adminstration: may the good Lord bless and keep you and eventually provide you with common sense...

We knew about the 30 days notice.. but the thing that i don't like is why they threaten me and my wife to pay 100k for school damages? there was no stipulation in the contract that the tenure should pay 100k for resigning in less than 30 days and wasnt able to finish the contract..
I could still say that even in just 4 days.. i made a letter to inform the school that we're leaving.. others just get their salary and move to another in school after the salary is released.

On my letter of resignation.. I told them that I would help the school to find replacements for the 2 teachers...
when i read that in the OP, i took it to be a typo and you meant June, not July.
4 Days notice is no good. You have created a problem for them. At this point; i'd recommend apologizing and sticking out your contract or just get the hell outta of dodge ASAP.

Thnk you Tomcat.. anyway, am not here to argue your point.. i only need some legal advice since i already made the move.. I need opinions who can possibly give solutions..
See, they feel they are being screwed, now they want to screw. Since 4 days IS a screw on your part why in Hell didn't you just collect your pay and jump on the midnight express?
Sorry I haven't a clue what you can do. The best advice: Screw them before they screw you, or don't screw them at all.
